1. scope of application and contract structure<\/strong><\/p>\n\n

GASTORO is a digital platform.<\/p>\n\n

Purchase contracts are concluded between:<\/p>\n\n

– the buyer (consumer or entrepreneur)<\/p>\n\n

– the respective dealer \/ seller<\/p>\n\n

GASTORO itself is not the contractual partner, but acts as an intermediary for the conclusion of the contract.<\/p>\n\n

The right of withdrawal therefore applies:<\/p>\n\n

towards the respective dealer<\/p>\n\n

2. RIGHT OF WITHDRAWAL FOR CONSUMERS (B2C)<\/strong><\/p>\n\n

2.1 Right of withdrawal<\/p>\n\n

Consumers within the meaning of the Consumer Protection Act (KSchG) have the right to withdraw from the contract within:<\/p>\n\n

14 days without giving reasons<\/p>\n\n

to revoke the contract.<\/p>\n\n

2.2 Start of the withdrawal period<\/p>\n\n

The period begins:<\/p>\n\n

For goods:<\/p>\n\n

– with the day on which the goods were taken over<\/p>\n\n

For partial deliveries:<\/p>\n\n

– upon receipt of the last delivery<\/p>\n\n

2.3 Exercise of the revocation<\/p>\n\n

The revocation is to be sent to:<\/p>\n\n

the respective retailer or via GASTORO (forwarding takes place)<\/p>\n\n

2.4 Consequences of revocation<\/p>\n\n

In the event of revocation:<\/p>\n\n

– Refund of all payments including standard delivery costs <\/p>\n\n

– within 14 days from revocation<\/p>\n\n

Repayment is made using the original means of payment.<\/p>\n\n

2.5 Return of the goods<\/p>\n\n

– to be returned within 14 days<\/p>\n\n

– to the respective dealer<\/p>\n\n

Costs of return shipment: generally borne by the buyer, unless otherwise agreed<\/p>\n\n

2.6 Loss of value<\/p>\n\n

A loss in value is only to be compensated if:<\/p>\n\n

the goods have been used beyond mere testing<\/p>\n\n

2.7 Exclusion of the right of withdrawal<\/p>\n\n

In particular, there is no right of withdrawal for:<\/p>\n\n

– perishable goods (e.g. food)<\/p>\n\n

– Sealed hygiene articles (after opening)<\/p>\n\n

– customized products<\/p>\n\n

– perishable catering items<\/p>\n\n

– services rendered in full<\/p>\n\n

3. RIGHT OF WITHDRAWAL FOR ENTREPRENEURS (B2B)<\/strong><\/p>\n\n

3.1 No statutory right of withdrawal<\/p>\n\n

entrepreneurs within the meaning of the UGB:<\/p>\n\n

No statutory right of withdrawal<\/p>\n\n

3.2 Individual agreements<\/p>\n\n

A right of withdrawal or return can:<\/p>\n\n

are only granted voluntarily by the retailer<\/p>\n\n

(e.g. take-back guarantee, goodwill regulations)<\/p>\n\n

3.3 Applicability of the dealer conditions<\/p>\n\n

The following applies to entrepreneurs:<\/p>\n\n

– the general terms and conditions of the respective retailer<\/p>\n\n

– Individual agreements<\/p>\n\n

– Commercial law regulations<\/p>\n\n

3.4 Returns in the B2B area<\/p>\n\n

Returns are only possible:<\/p>\n\n

– with the express consent of the retailer<\/p>\n\n

– in the event of defects (warranty)<\/p>\n\n

– with contractual agreement<\/p>\n\n

4. PLATFORM TRANSPARENCY & MANDATORY DISCLOSURES<\/strong><\/p>\n\n

The following principles apply on GASTORO to ensure transparency and legal clarity:<\/p>\n\n

4.1 Labeling at the time of purchase<\/p>\n\n

Before completing an order, the buyer is clearly requested to indicate whether the purchase is being made as:<\/p>\n\n

– Consumer (B2C)<\/p>\n\n

– Entrepreneur (B2B)<\/p>\n\n

This selection is decisive for the application of the right of withdrawal.<\/p>\n\n

4.2 Obligations of dealers<\/p>\n\n

Every retailer is obliged:<\/p>\n\n

– provide their own return and withdrawal policies<\/p>\n\n

– clearly explain the differences between B2C and B2B regulations<\/p>\n\n

– transparently indicate product-specific restrictions (e.g. food, custom-made products)<\/p>\n\n

4.3 Presentation on the platform<\/p>\n\n

The relevant information is:<\/p>\n\n

– on the product page<\/p>\n\n

– in the order process<\/p>\n\n

– and in the dealer profiles<\/p>\n\n

displayed clearly and comprehensibly.<\/p>\n\n
